Privacy Policy

This Privacy Policy (“Policy”) applies to the mobile application “apna AI” (“apna AI”) whether accessed from a mobile phone or other devices and its allied services (“Services”) as operated and provided by Invenics Ltd. (“Company”). This Policy describes the use of apna AI and sharing of certain personal information submitted by its registered users (the “User(s)” or “You” or “Your”) at the time of registration and from time to time in order to be able to enjoy the Services (“Services”). The Services offered adhere to all the laws, rules, regulations and policies (“Applicable Laws”) with regard to the collection, assimilation, use, disclosure, retention and 
protection of your information including personal data that apna AI is likely to have access to as a 
result of your use of the Services.

1. Collection of Information.

1.1. Personal Information. Any data about you, by which you, as a person can be identified, including without limitation, your full name, gender, business name, its address, your address, email address, date of birth, date of incorporation, any identity proof number, phone number, mobile number, employment details, business card, identity card and any other such personal information pertaining to you, to which apna AI has or is likely to have access by virtue of your voluntary submission (“Personal Data”). Personal Data shall also include the information of such third parties that apna AI may have access to during the course of providing the Services to you. It is noted that apna AI collects such Personal Data from you because of your voluntary submission of such information in order to enjoy the Services.

1.2. Anonymous Data. apna AI may also collect such other anonymous data that is not associated with or linked to any Personal Data (“Anonymous Data”) and which, by itself, does not pertain to the identification of any individual User. Anonymous Data includes without limitation, unique identifiers of the device on which apna AI is installed, such as VPN, information of WiFi connectivity and such other information. apna AI may also store these unique identifiers, at times and create a profile for you based on such Anonymous Data, which in turn allows you to have a better browsing experience on apna AI

1.3. Usage Information. In addition, apna AI may automatically collect certain other information, including but not limited to usernames, passwords, and other security and usage related information, whenever you visit or utilize the Services such as Log Data, Analytical Code, Time Stamp, Geo Stamp, IP address, version and identification number of apna AI and device, browser type, browser language, the date and time of your request, your profile, websites visited by you, search terms used, your mobile carrier data, platform type, number of clicks, phone number, requested status of other Users and various status information and other personal setting information with regard to your usage of the Services provided through apna AI (“Usage Information”). Such Usage Information collected is not associated with any Personal Data and is tagged to the unique 2 identifier of a particular device

2. Usage of Information. apna AI may use the Personal Data and other information collected as mentioned above for any of the following purposes:


(a) to enable apna AI to effectively provide the Services to you;

(b) for the purposes of verification of software version or administration of software upgrades;

(c) to allow you and to enable you to participate in surveys regarding Services;

(d) to maintain the highest quality of the Services and provide general statistics regarding their use and performance;

(e) to deliver Services, including email notifications, confirmations, technical notices,updates, security alerts, and support and administrative messages that you may request;

(f) to maintain records or backup;

(g) to alert you about updated information and other such new or updated services that may be offered by apna AI;

(h) to allow you access to exclusive features and functionality of apna AI;

(i) to launch and/or open other mobile applications installed on your device based on functionality of apna AI and your personal preferences; and(j) to resolve disputes, collect fees and troubleshoot problems effectively.

3. Sharing of Information.


3.1. To whom the information is shared. apna AI may share the Personal Data received fromyou:


(a) With the Company’s affiliates in connection with matters relating to the consumptionof Services by you to help detect and prevent identity theft, fraud and other potentiallyillegal acts; correlated or multiple accounts to prevent abuse of Services; and tofacilitate joint or co-branded services that you request, where such services areprovided by more than one corporate entity other than the Company; and


(b) if required to do so by law or regulation; to its legal counsel, law enforcement officers,governmental authorities or any other authority as the case may be who have assertedtheir lawful authority to obtain the information or where the Company has in goodfaith and has reasonable grounds to believe that such disclosure is necessary to enforceits Terms of Use or this Privacy Policy

3.2. Representation. The Company hereby agrees not to rent, sell, or otherwise provide PersonalData received from you to third parties without your expressed consent, except as describedin this Policy or as required by law. However, the Company and its affiliates reserve the rightto share, sell and transfer some or all of the Personal Data to other business entities shouldthe Company, or its assets, plan to merge with, or be acquired by that business entity

4. Retention of Information. The Company retains your Personal Information and other information for as long as your account is active or as needed to provide you with our Services. If you delete your account, we will delete your Personal Information from ourservers within 90 days.

5. Security of Personal Information


5.1. Security Measures. The Company has implemented commercially reasonable physical, electronic, managerial, operational and technical security measures to protect the loss, misuse, alteration and security of the Personal Data received from you. Data is stored securely on Google Cloud Services under two-factor authentication with need-to-know basis access only. The Company’s security practices and measures may include, where appropriate, the use of firewalls, encrypted server facilities, secure server facilities, implementing proper access rights management systems and processes, careful selection of processors, standard authentication and encryption policies for its servers and other technically and commercially reasonable measures. However, no security measure is perfect, the Company cannot guarantee the security of your Personal Information.

5.2. Disclaimer. The Company is committed to protecting the security of any Personal Data and uses reasonable efforts including a variety of security technologies and procedures to help protect such Personal Data from any unauthorized access, use, misuse or disclosure. The Company will take all reasonable measures in furtherance of the above commitment. However, the Company cannot guarantee that the Personal Data received from you and other information stored on the servers will be absolutely protected. The Company’s systems and the communications networks through which you access apna AI may be subject to security breaches and failures due to circumstances beyond Company’s reasonable control. These may include computer "hacking", data theft or and physical theft among others. In such situations, the Company will try to rectify the problems to best of its abilities assoon as possible.

5.3. Deleted Information. Any data destroyed shall be disposed of in a manner that protects theprivacy of the Personal Data received by apna AI from you in an appropriate manner as perthe standard practices of the industry and norms. However, certain information about youmight be stored in the server as default even after termination of your account, which will inno way be accessed by any person other than authorized representative of the Company orshared to any third party by the Company. The User hereby acknowledges and understandsthat all Personal Data provided in using apna AI is with their knowledge and consent and alsothat it is at their own risk.

6. Obligations of Users.


6.1. As a registered user of the Services, you have certain obligations to other users and to the Company. Some of these obligations are imposed by Applicable Law and regulations, and others have become commonplace for Services as offered by apna AI:


(a) you must, at all times, abide by the terms and conditions of the most recent and then prevailing Privacy Policy and Terms of Use. This includes respecting all intellectual property rights that may belong to third parties and also those which belong to the Company;

(b) you must not upload or insert any comments or content that may be deemed to be injurious, violent, offensive, racist or xenophobic, or which may otherwise violate the purpose and spirit of apna AI, Company and its community of users or anyone else;

(c) You must keep your username and passwords confidential and not share the same with others; and

(d) All information given must be genuine and true to the best of your knowledge. The Company shall not be held responsible in case of any fraudulent information given at the time of registration for using apna AI

6.2 Any violation of the guidelines as mentioned in Clause


6.1 may lead to the restriction, suspension or termination of your account with the apna AI, at the sole discretion of the Company.


7. Governing Law. The usage of the Services is exclusively governed by the laws of India and the jurisdiction of the courts in Delhi, India. The Company expressly disclaims any implied warranties or liabilities imputed by the laws of any other jurisdiction.

8. Modifications. Any changes in this Policy by the Company shall be posted on apna AI to reflect changes in its Privacy Policy so that you are always aware of what information apna AI collects, uses, and under what circumstances, if any, Company may disclose it. You should periodically review the above-mentioned page for the latest information on apna AI’s privacy practices. Once posted, those changes are effective immediately. Continued access or use of apna AI constitutes your acceptance of the changes and the amended Policy.


9. Third party application stores. apna AI can be downloaded from third party application stores including Google Play Store and Apple App store. apna AI may contain links to other third-party websites that may collect the Personal Data. The User agrees to comply with all third party privacy policies, if any, applicable to the use of such applications or its services. The Company is not responsible for the User’s use of any third party product and/or service including the terms and conditions, privacy practices or the content of those linked websites or such third party product and/or service or violation and infringement of any third-party.

10. Advertisements. apna AI may use third-party advertising companies to serve advertisements when you contact it. These companies may use information (not including name, address, email address, or telephone number of the user) about your visits to apna AI and other websites in order to provide advertisements about goods and services of interest to you.


11. Data Protection Principles. In accordance with the General Data Protection Regulation (GDPR), we adhere to the principles of lawfulness, fairness, and transparency. We collect and process personal data only where we have legal grounds to do so. We ensure that personal data is used in a way that is lawful, fair, and transparent to you, is collected for specified and legitimate purposes, and is kept accurate and up to date.


12. Lawful Basis for Processing. We process your personal data on the basis of one or more of the following lawful grounds: consent, contract, legal obligation, vital interests, public task, or legitimate interests. When we process personal data based on your consent, you have the right to withdraw that consent at any time.


13. Rights of the Data Subject. Under GDPR, you have several rights in relation to your personal data, including the right to access, rectify, erase, restrict processing, object to processing, and the right to data portability. You also have the right to lodge a complaint with a supervisory authority.


14. Data Transfers. Personal data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy

15. Data Protection Officer. Our Data Protection Officer (DPO) is responsible for overseeing questions in relation to this privacy policy. 16. Data Breach Notification. In the event of a data breach, we will notify you and any applicable regulator of a breach where we are legally required to do so.


17. Amendments and updates. We may update this policy from time to time by publishing a new version on our website. You should check this page occasionally to ensure you are happy with any changes to this policy.
